Acceptance of these terms

These Terms & Conditions ("Terms") are a binding agreement between you and Balmelo, a brand of The Nelson M Group LLC ("Balmelo," "we," "us"). They govern your use of balmelo.com and related services, such as email and text-message programs (the "Services"). By using the Services or submitting a form, you agree to these Terms, our Privacy Policy, and, if you opt in to texts, our SMS Terms. Anyone who does not agree to these Terms must stop using the Services.

What Balmelo is, and is not

Balmelo is an information service. We publish general, plain-language information about health and beauty topics, and let visitors opt in to related updates. We will not sell products or treatments, make medical claims, give medical advice, diagnose or treat any condition, match people with clinicians, retailers, or service providers, or refer people to providers, and we never share your details with clinicians, retailers, or other partners.

• Decisions about your skin, hair, body, and routine are yours. Reading our content does not obligate you to do anything.
• The clinician, retailer, or brand you deal with, not Balmelo, sets its own products, prices, and advice and is responsible for its own work and decisions.
• Skin, hair, products, and results vary from person to person. We do not guarantee that any habit, ingredient, or product will work, cost or save any amount, or turn out any particular way.

Eligibility

You may use the Services only if you are 18 or over, are in the United States, and are able to agree to a binding contract. Information you submit must be about you, or about a person who has authorized you to submit it.

Your information and accuracy

Please keep the details you give us correct and current. Enter a mobile number only if you own it or are authorized to use it. If your number changes or is reassigned, please reply STOP from the old number or contact us so that we do not message someone else.

Communications and text-message consent

By opting in, you agree that we may reach you by email and, where you check the relevant boxes, by automated text messages as outlined in the SMS Terms. Consent to texts is optional, is not a condition of purchase or of using the Services, and may be withdrawn at any time by replying STOP. Message frequency varies. Message and data rates may apply. • HELP: Reply HELP to any message for help, or contact us by email at [email protected] or by phone at 877-289-1651. Also, please message HELP to any of our numbers to receive help or information about the number.

Mobile information and opt-in data are not sold or shared with third parties or affiliates for marketing or promotional purposes. See the Privacy Policy and SMS Terms.

Acceptable use

You must not: (a) enter false or misleading details, or another person's details; (b) use the Services for anything unlawful, fraudulent, or abusive; (c) interfere with the Services or try to gain access you are not allowed; (d) submit forms with bots or other automated tools; (e) copy, scrape, or resell our content without our permission; or (f) pretend to be someone else. We may suspend or end your access if you do any of these.

Third-party organizations and links

Organizations, programs, and products mentioned on or linked from the Services (for example government agencies, manufacturers, or nonprofit organizations) are run by third parties. We do not endorse any product, brand, or provider and are not responsible for the conduct, content, or results of third parties. Your relationship with a retailer, brand, or health professional is between you and them.

Intellectual property

The Services, among them the Balmelo name, logo, text, graphics, and design, are owned by us or our licensors and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to view and use the Services for personal, non-commercial purposes.

Disclaimers

The services and all content are offered "as is" and "as available," with no warranty of any kind, express or implied, among them any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We make no promise that the services will run without interruption or error, be secure, or that messages will arrive, or arrive on time.

Balmelo does not supply medical, professional, legal, or financial advice, and makes no representation about any product, ingredient, result, or health outcome.

Limitation of liability

As far as the law allows, Balmelo and The Nelson M Group LLC, and their members, managers, officers, employees, and agents, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of (or inability to use) the services, or from any health, beauty, or product decision you make or do not make. Our total liability for any claim relating to the services will not exceed one hundred U.S. dollars ($100).

Not every jurisdiction allows these limitations, and some of them may therefore not apply to you. No provision of these Terms limits liability where the law forbids limiting it.

Indemnification

You agree to defend and hold harmless The Nelson M Group LLC, its affiliates, and its personnel against claims, damages, and expenses (including reasonable attorneys' fees) that arise from your breach of these Terms, your misuse of the Services, or your supplying a phone number or other information you had no authority to provide.

Disputes, governing law, and arbitration

Informal resolution first. Before you file any claim, reach us at [email protected] and allow us 30 days to try to resolve it before you file a claim.

Binding arbitration. Apart from small-claims matters and injunctive-relief claims over intellectual-property misuse, every dispute between you and Balmelo or The Nelson M Group LLC arising from or relating to these Terms or the Services shall be resolved through final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. At your choice, the arbitration is held in your county of residence or by video or phone. An arbitrator may award the same individual relief as a court, and judgment on the award can be entered in any court with jurisdiction.

Class-action waiver. You and Balmelo each waive, to the extent the law permits, any right to bring claims as a plaintiff or class member in a class, collective, or representative action; claims may be brought on an individual basis only.

Opt-out. To opt out of arbitration within 30 days of first accepting these Terms, email [email protected] using the subject line "Arbitration Opt-Out" and giving your name and mobile number.

Governing law. Governing law: the Federal Arbitration Act and the laws of the state in which The Nelson M Group LLC has its principal place of business, without regard to conflict-of-law rules. Except as the arbitration clause supplies, exclusive jurisdiction lies with the state and federal courts located in that state.

Termination

You may stop using the Services at any time, and may opt out of messages by replying STOP. We may suspend or end your access at our discretion, including if you violate these Terms. Any section that by its nature should continue (such as disclaimers, limitation of liability, indemnification, and disputes) will survive termination.

Changes

We can amend these Terms by posting a new version with a new "Last updated" date; if you hold using the Services after the effective date, you accept the amended Terms. We will give legally needed notice of material changes.

General

These Terms, together with the Privacy Policy and SMS Terms, are the entire agreement between you and us on this subject. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent, and we may assign them in connection with a merger or sale of the business.
